The Supreme Court is Set to Review a Challenge to Roe v. Wade

The Mississippi case may not explicitly overrule Roe, but it puts it “squarely in the crosshairs.” At issue: In 2018, Mississippi passed a law banning most abortions after 15 weeks, significantly before fetal viability and the 6 months decided in Roe. The 5th Circuit Court of Appeals blocked enforcement of the law, finding it conflicted with Roe and subsequent decisions. On May 17, the Supreme Court announced it has granted Mississippi’s petition and will review the 5th Circuit’s decision. The Court: In 2016, the Supreme Court affirmed similar rulings to the one at issue, but its makeup is now vastly different. Since then, Mitch McConnell (R-KY) blocked Merrick Garland’s nomination, Justice Anthony Kennedy retired, and Justice Ruth Bader Ginsburg passed away, allowing former President Donald Trump to appoint three solidly conservative justices. The Court will hear the case in its term beginning in October and a decision is likely to come by June 2022.
